These Terms & Conditions (the “Terms”) govern your access to and use of the website www.qwikfolio.com (the “Website”) and the Qwikfolio application and services (collectively, the “Service”), operated by Zuke Technologies LLC (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

Qwikfolio provides private text-in phone numbers that allow you to collect photos, videos, and messages from contributors, along with automated moderation, enhancement, branding, and display tools such as slideshows, galleries, PowerPoint exports, embeds, and webhooks. Features may change as we improve the Service.

2. Accounts & Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@qwikfolio.com if you suspect unauthorized use.

3. Subscriptions & Billing

Certain features require a paid subscription. Subscription fees, billing cycles, and included features are described at the time of purchase. Unless otherwise stated, subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

4. Acceptable Use

You agree not to use the Service to collect, store, or distribute content that is unlawful, infringing, defamatory, harassing, sexually explicit involving minors, or otherwise objectionable; to violate any applicable law, including telecommunications and anti-spam regulations; to attempt to probe, disrupt, or gain unauthorized access to the Service; or to resell the Service without our written consent. We may suspend or terminate accounts that violate this section.

5. Your Content

You (and your contributors) retain ownership of the photos, videos, and messages submitted through the Service (“Content”). By using the Service, you grant us a limited, worldwide, non-exclusive license to host, process, moderate, transform (e.g., enhance, watermark, caption, resize), and display Content solely to provide the Service to you. You are responsible for ensuring that you have the necessary rights and permissions — including from your contributors — to collect and display Content.

6. Automated Moderation

The Service uses automated, AI-based content moderation to help exclude inappropriate material. While highly effective, no automated system is perfect; we do not guarantee that all objectionable content will be caught or that appropriate content will never be flagged. Review tools are provided so you can make the final call on flagged items.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

The Service, including its software, design, logos, and documentation, is owned by Zuke Technologies LLC and protected by intellectual property laws. Except for the limited rights expressly granted to you, no rights in the Service are transferred by these Terms.

9. Third-Party Services

The Service interoperates with third-party services (for example, telecommunications carriers and hosting providers). We are not responsible for the availability or conduct of third-party services, and your use of them may be subject to separate terms.

10. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Content will never be lost — please maintain your own copies of irreplaceable media.

11. Limitation of Liability

To the fullest extent permitted by law, Zuke Technologies LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.

12. Termination

You may stop using the Service and cancel your account at any time. We may suspend or terminate your access to the Service if you materially breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ceases; sections that by their nature should survive (including Sections 5, 8, 10, and 11) will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page with a new effective date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States and the state in which Zuke Technologies LLC is organized, without regard to conflict-of-law principles.
